Terms & Conditions

All services are by appointment only. We do not accept walk-in clients. Appointments may be scheduled online through our booking portal (Meevo), by phone at (901) 507-2333, or by text at (901) 506-0006.

A valid credit or debit card is required to hold your appointment. Your card will not be charged at the time of booking unless you fail to provide required cancellation notice (see Section 2 below).

We reserve the right to decline or cancel appointments at our sole discretion, including in cases of disrespectful conduct toward staff.

We understand that emergencies happen. If you have an extenuating circumstance, please contact us as soon as possible and we will do our best to accommodate you. Late cancellation fees are assessed at our sole discretion.

We reserve the right to cancel or reschedule appointments due to staff illness, inclement weather, or other circumstances beyond our control. We will notify you as soon as possible and offer rescheduling at no additional charge.

Payment is due at the time of service. We accept:

• Credit cards (Visa, Mastercard, American Express, Discover)
• Debit cards
• Cash
• Personal checks
• Living Health Day Spa gift certificates

We do not currently accept digital wallets (Apple Pay, Google Pay, etc.). All prices are in U.S. dollars and are subject to change without notice.

• Gift cards are available for purchase online or in-spa in any dollar amount.
• Gift cards never expire and have no fees.
• Gift cards are redeemable for any service or product at Living Health Day Spa.
• Gift cards are not redeemable for cash and cannot be refunded after purchase.
• Lost or stolen gift cards cannot be replaced. Please treat them like cash.
• Gift card balances may be applied to services. Any remaining balance stays on the card for future use.

Living Health Day Spa offers monthly membership plans subject to the following terms:

• Memberships are billed monthly and require a one-time $25 enrollment fee at sign-up.
• The initial membership term is one month. Memberships automatically renew monthly unless canceled in writing.
• Monthly membership benefits (massage or facial credit) expire at the end of each monthly billing period and do not roll over.
• Membership discounts apply to services and products at their listed rates at time of service.
• Memberships may be paused or canceled by providing written notice to us at relax@livinghealthdayspa.com at least 7 days before your next billing date.
• Memberships are personal and non-transferable.
• We reserve the right to modify membership pricing or benefits with 30 days' written notice.

Your safety and wellbeing are our first priority. Please inform your therapist or esthetician of any medical conditions, allergies, medications, or recent injuries before your service begins. Some services may be contraindicated for certain conditions.

We reserve the right to modify or decline a service if we believe it may be unsafe for you. This includes, but is not limited to, services during pregnancy (except our prenatal massage), active skin infections, open wounds, or recent surgeries.

By booking and receiving services, you acknowledge that you have disclosed all relevant health information and accept responsibility for any health conditions not disclosed to us.

By accessing our website, you agree to use it only for lawful purposes and in a manner that does not infringe on the rights of others. You may not:

• Use the site to transmit spam, malware, or other harmful content.
• Attempt to gain unauthorized access to any portion of the site or our systems.
• Reproduce, distribute, or commercially exploit any content from this site without our written permission.

We reserve the right to terminate access to the website for any user who violates these Terms.

All content on this website — including text, images, logos, graphics, and design — is the property of Living Health Day Spa or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws. Unauthorized use is prohibited.

Our website and services are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses. Spa services are wellness services and are not intended to diagnose, treat, cure, or prevent any medical condition.

To the fullest extent permitted by applicable law, Living Health Day Spa, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website, including but not limited to loss of revenue, loss of data, personal injury, or property damage.

Our total liability to you for any claim arising from your use of our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Some states do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Living Health Day Spa and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of our website or services, your violation of these Terms, or your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Shelby County, Tennessee.

We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting to this page, with the "Last Updated" date revised accordingly. Your continued use of our website or services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
